1. About Poké-Vend

Poké-Vend LLC is a Michigan-based company that sells Pokémon Trading Card Game products, both directly online and through our branded vending machines placed at partner venues.

2. Products and Purchases

All product descriptions, pricing, and availability on this Site are subject to change without notice. Sales tax is calculated based on the shipping address provided at checkout. Payment is processed securely through our third-party payment provider; Poké-Vend does not store your full payment card details.

3. Machine Purchases and Leases

Machines purchased or leased through poke-vend.com are governed by a separate Purchase Agreement or Lease-to-Own Agreement, signed electronically at checkout. These Terms of Service apply in addition to, not in place of, that signed agreement. In the event of a conflict between these Terms and a signed Purchase or Lease-to-Own Agreement, the signed agreement controls for matters it specifically addresses.

4. Website Use

You agree to use this Site only for lawful purposes. You may not attempt to interfere with the Site's normal operation, access data not intended for you, or use the Site to transmit anything harmful or unlawful.

5. Intellectual Property and Trademarks

The "Poké-Vend" name, the Poké-Vend logo, the poke-vend.com domain, and all associated branding and trade dress are the property of Poké-Vend LLC. No person or business may use Poké-Vend's name, logo, branding, or domain in connection with any product, machine, service, business, or marketing material without Poké-Vend LLC's prior written permission. This includes, without limitation, any vending machine that has been resold or transferred outside of Poké-Vend's own authorized network, regardless of whether that machine still displays Poké-Vend's physical branding.

All other content on this Site, including text, graphics, logos, and images (excluding licensed Pokémon Trading Card Game product imagery and trademarks, which remain the property of their respective owners), is the property of Poké-Vend LLC or its licensors.

6. Limitation of Liability

To the fullest extent permitted by law, Poké-Vend LLC is not liable for any indirect, incidental, or consequential damages arising from your use of this Site or your purchase or use of any product or machine, except as otherwise stated in a signed Purchase or Lease-to-Own Agreement.

7. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws principles. Any dispute shall be resolved exclusively in the state or federal courts located in Michigan.

8. Changes to These Terms

We may update these Terms from time to time. Continued use of this Site after changes are posted constitutes acceptance of the updated Terms.
